These Terms of Service (“Terms”) govern your use of Topicfinder, a competitive research app (“the App”), provided by Topicfinder (“we,” “us,” or “our”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.

1. Account Registration

1.1. In order to use the App, you must create an account by providing accurate and complete information, including your name and email address. You are solely responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

1.2. You must be at least 18 years old or have the necessary legal capacity in your jurisdiction to enter into these Terms.

2. App Usage and Limitations

2.1. The App is designed to assist users in finding top-performing content topics. You acknowledge that the App’s effectiveness may vary based on various factors and results are not guaranteed.

2.2. Your usage of the App is subject to certain limitations, including but not limited to:

a) Credit Limits: Your account is allocated a specific number of credits, which determine your usage of the App. Additional credits may be purchased separately.

b) User Limits: The number of users per account is restricted to the limit specified in your subscription plan.

c) Simultaneous Reports: You may only have a maximum of three (3) simultaneous reports running at any given time.

2.3. You agree to use the App in a manner consistent with its intended purpose and to refrain from circumventing any limitations or engaging in any activity that may negatively affect the service for other users.

3. Subscription and Payment

3.1. The App is a paid service, and you agree to pay the applicable subscription fees as set forth on the App’s website or as otherwise communicated to you.

3.2. Subscription fees are billed on a monthly recurring basis and are non-refundable. By providing your payment information, you authorize us to charge the specified amount to your chosen payment method.

3.3. We reserve the right to modify the subscription fees, provided that any changes will be communicated to you in advance. Continued use of the App after such notification constitutes acceptance of the revised fees.

4. User Responsibilities and Conduct

4.1. You are solely responsible for your use of the App and any content you generate or contribute while using the App.

4.2. You agree to use the App in compliance with applicable laws and regulations and to respect the rights of other users. You must not engage in any activity that may cause harm, disrupt, or negatively impact the App or its users.

5. Intellectual Property

5.1. The App and all its associated software, trademarks, logos, and content are the intellectual property of Topicfinder and are protected by applicable intellectual property laws.

5.2. You acknowledge and agree that all content provided by the App, including but not limited to reports, recommendations, and analysis, are owned by Topicfinder and are for your personal use only. You may not reproduce, distribute, modify, or create derivative works based on such content without our prior written consent.

6. Disclaimers and Limitation of Liability

6.1. The App is provided on an “as is” and “as available” basis, without any warranties, express or implied. We make no representations or warranties regarding the accuracy, reliability, or completeness of the App’s content or its suitability for your specific needs.

6.2. To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising out of or in connection with your use of the App.

7. Termination

7.1. We reserve the right to suspend or terminate your access to the App at any time and for any reason, without notice or liability.

8. Governing Law and Jurisdiction

8.1. These Terms shall be governed by and construed in accordance with the laws of the State of California, United States. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the state or federal courts located in Ventura County, California.
